Course Overview

This training course will consider how the Mental Capacity Act should be implemented in the young person support setting and how work practices are influenced by the legislation.

This training course will focus on understanding the five basic principles of the Act and how they should be implemented in a real world situation.

This training course will introduce the Deprivation of Liberties Safeguards. It will give attendees the knowledge of when it is or is not appropriate to deprive a person of their liberty, how to recognise poor practice and positive alternatives to put in place.

This training course will support attendees to develop their skills and understanding in order to increase the independence and quality of life of the young people they support.

This training course will look at how to use the Mental Capacity Act and the Deprivation of Liberties Safeguards to ensure life is something the young people support are part of, not something that happens to them.

  • 2.1Explain what is meant by “lack of capacity”
  • 2.2Explain how capacity can fluctuate
  • 2.3Summarise the main ways capacity can be impaired
  • 2.4Explain what is meant by “impairment or disturbance” and what this could be caused by
3Understand how to correctly assess whether a young person lacks the capacity to make a decision or not
  • 3.1Explain the four factors used to make a decision when assessing capacity
  • 3.2Summarise the key questions to ask when assessing capacity
  • 3.3Explain the limitations on when a decision can be made for another person
  • 3.4Demonstrate an understanding of the basic principles using relevant case studies
4 Understand the key points of the Deprivation of Liberties Safeguards (DoLS)
  • 4.1Explain how DoLS relates to the Mental Capacity Act
  • 4.2Explore which practices could be viewed as depriving a person of their liberty
  • 4.3Explain the legal definitions of restrictive practice and what can constitute an offence
  • 4.4Summarise the Duty of Care support workers and others have towards the young people they support in relation to both MCA and DoLS
